FZulG: Intent and Core Rules

The Forschungszulagengesetz (FZulG) serves to incentivize Research and Development (R&D) across all industries in Germany. The Bescheinigungsstelle Forschungszulage (BSFZ) evaluates the technical and scientific validity of projects, while the tax office (Finanzamt) handles financial processing.

1. Fundamental Research Categories

To qualify, a project must align with at least one OECD Frascati category:

  • Grundlagenforschung (Basic Research): Acquiring foundational knowledge without direct commercial application.
  • Industrielle Forschung (Industrial Research): Planned research for new/improved products or processes. Includes lab prototypes.
  • Experimentelle Entwicklung (Experimental Development): Utilizing existing knowledge to overcome substantial technological barriers for new/improved products.

2. The Analytical Triad (BSFZ Core Criteria)

All three conditions must be cumulatively fulfilled for eligibility:

  • Neuartigkeit (Novelty): The project must transcend the industry's current state of the art, not just be internally new.
  • Unwägbarkeit (Uncertainty/Risk): Significant technological or scientific barriers must exist. Economic/market risks are strictly excluded.
  • Planmäßigkeit (Systematic Approach): The project must follow a documented, budgetable methodology with defined milestones and work packages.

BSFZ Compatibility Scorecard

Evaluation of project activities relies on distinct positive and negative indicators.

Positive Indicators (+1 to +2)

  • Generation of entirely new industry knowledge or foundational science.
  • Documentation of massive technical/scientific risks at project start.
  • Digital development and simulation processes.
  • Systematic documentation, phase planning, and lab-environment prototypes.

Negative and K.O. Indicators (-1 to -2)

  • Administrative tasks, routine bug fixing, or general QA/support.
  • Minor product adjustments without fundamental technical shifts.
  • Market launch, sales building, and pre-project feasibility studies (Strict exclusion).
  • Uncertainty based solely on economic or market risks (Strict exclusion).

High-Level API Surface & Financials

Two-Stage Setup Instructions

  1. BSFZ Certification (Technical): Apply via the BSFZ portal. Focus strictly on narrative precision regarding technical novelty, risk, and planning. No cost data is submitted here.
  2. Financial Claim (Fiscal): Calculate the exact basis of assessment (Bemessungsgrundlage) and claim the allowance via the tax return (ELSTER). Requires manipulation-proof documentation of R&D hours.

Funding Parameters (Wachstumschancengesetz Updates)

  • Maximum Basis of Assessment: €10 million annually (effective March 28, 2024), scaling to €12 million in 2026.
  • Eligible Costs:
    • Direct personnel costs for R&D staff.
    • Depreciation of capital assets (abnutzbare bewegliche Wirtschaftsgüter) used exclusively for the R&D project.
    • 70% of external contract research costs.
    • Flat rate of €70/hour for sole proprietors/partners.
  • SME Bonus: Small and Medium-sized Enterprises can claim an elevated funding rate of 35%.
